Missouri Attorney General Andrew Bailey is initiating a lawsuit against the Biden administration, alleging that it has been transporting illegal immigrants to Missouri.

In an interview with Fox News Digital, Bailey stated that he is suing President Biden and Vice President Kamala Harris for their failure to provide documents regarding the transportation of illegal immigrants into Missouri.

“We have grounds to suspect that they are intentionally shipping illegal immigrants from the border to our cities. Not on my watch,” Bailey asserted in a post on X.

In the lawsuit he disclosed exclusively to Fox News Digital, Bailey claims that the Department of Homeland Security (DHS) has deliberately postponed its response to his request for information related to the flights into Missouri.

“This game of ‘hide and seek’ defies the spirit and the regulations of FOIA, which states that an agency should only withhold information when it ‘reasonably foresees that disclosure would harm an interest protected by an exemption’ or if ‘disclosure is prohibited by law’,” the lawsuit states.

“The DHS’s refusal to provide vital information has obstructed citizens’ rights outlined in the FOIA statute. This lack of transparency and noncompliance with legitimate FOIA requests has impeded the Missouri Attorney General’s Office from assessing the extent of illegal immigration in the Show Me state,” the lawsuit continues.

Bailey emphasized that the transportation of illegal immigrants into Missouri is of public interest, and the people of Missouri deserve to be informed about these alleged activities.

The lawsuit also contends that DHS failed to notify that there would be delays in responding to the request due to “unusual circumstances.”

Bailey mentioned that DHS has not only not provided any documents in response to the request but also has not shown that any responsive records are exempt from production. He also noted that DHS has not indicated when it will provide the requested documents.

“Once again, the Biden Administration is attempting to circumvent the law in order to keep information from the American public,” Bailey claimed. “Their latest refusal to clarify the situation regarding the transportation of illegal immigrants into Missouri is merely the beginning.”

Bailey pointed out that this inaction illustrates a broader trend of using delay tactics and diversion to avoid fulfilling document requests made under FOIA.

“Here in Missouri, we hold wrongdoers responsible when they fail to follow the law, even if it’s the federal government. I will continue until I get answers for the people of Missouri,” Bailey declared.

In June, Missouri was part of an 18-state coalition that filed a lawsuit against the Biden administration for its proposed “Circumvention of Lawful Pathways,” which allowed “large numbers of immigrants to enter the country and gain immediate work authorization and quick access to public benefits.”

“The situation at the southern border is out of control, all thanks to Joe Biden,” Bailey previously stated. “He neglects his constitutional duties, so we’re taking legal action to compel him to fulfill his responsibilities.”
